04/05/2012 People vs. Mrs. Smith

I wonder why I have never heard about a company being sued for murder… Think about this:

Everyday in the morning when Mrs. Smith made her husband John’s coffee, she added her own secret ingredient… a dash or arsenic, for flavor enhancement.  Over time John develops: headaches, confusion, severe diarrhea, and drowsiness.  As the years go on and John grows older his health deteriorates.  He developes chronic diarrhea, vomits often, has blood in this urine, cramping muscles, hair loss, stomach pain, and convulsions.   Eventually  John’s lungs, kidneys, and liver begin to massively fail and after 10 years of Mrs. Smith adding her special ingredient, John slips into a coma and dies at 54.  Did Mrs. Smith commit murder?  Yes or no.  Why?  Would your answer be different if John died after 15 years?  Twenty years?  What penalty does she serve if any?

If Mrs. Smith was actually Mrs. Smith Coffee CO. INC.  would you think differently?  Why or why not?
